These actions often involve construction contracts and disputes, construction defect litigation, architect and contractor negligence actions, payment disputes, and the assertion and defense of mechanic's liens and stop notices.

Environmental Law and Litigation

We also assist clients with environmental matters, including representing clients before various California state agencies, including the Department of Toxic Substances Control and the State Water Quality Control Board, and assisting clients in related enforcement and cost recovery litigation, whether instituted by public agencies or private parties. We also have experience assisting clients with state-monitored cleanup of previously-contaminated property for redevelopment.

It is typically productive to mediate as early as possible and before the attorneys’ fees and costs have been incurred (and paid) to the point that the parties are dug into their positions and unwilling to waive those expenses, which can be very significant, as a condition of a settlement. On the other hand, sometimes it is necessary to perform some discovery or file a motion or two to set the stage for a successful mediation. Greg Peterson is experienced and well versed in these matters, and he can help clients develop an economically sensible strategy for successful mediation. We are well-versed in alternative dispute resolution and mediation procedures. In addition to serving as a Settlement Conference Judge (Pro Tem), Mr. Peterson also makes himself available as a mediator to assist in the resolution of matters involving his areas of expertise and has been called upon by a number of attorneys in the Sacramento area to serve as a mediator. For more information, please see our page concerning the mediation process.
